After many years of discussion, preparation, and recent delays, it has finally been announced that the Unified Patent Court Agreement (UPCA) will come into effect on 1 April 2023, with the so-called Sunrise Period beginning on 1 January 2023. This means that for European patents granted on or after 1 April 2023, and for the duration of the transitional period, applicants will be able to choose between conventional European patents or European patents with unitary effect (see our article). This also means that it is now time for applicants and proprietors with pending European applications or granted European patents to decide whether to opt-in or op-out of the Unified Patent System (see our article).

Beck Greener have been preparing for this and we will shortly contact you to discuss the best strategy for your application(s) or patent(s). In the meantime, if you have any questions regarding the Unified Patent System, please do not hesitate to contact us.
