Artificial intelligence (AI) is one of today’s most exciting technologies. Although AI has a long history, it is only recently that we have seen extraordinary growth in this field driven and enabled by advances in machine learning, increased computing power and availability of data, for example coming from the countless IoT devices now found in homes and industry. AI is now recognized as a primary driver of computing development and useful commercial applications of AI have become commonplace. For example, AI learning, prediction and optimisation plays a key role in ‘smart’ systems, such as smart homes, smart cities, etc. AI advances in computer vision are vital to the operation of autonomous vehicles and robots. Classification algorithms are key in diagnostic applications and image processing. Natural-language processing and speech recognition play a key role in voice activated user interfaces.

This surge in the AI industry has also spurred a flood of AI-related patenting. AI, like software in general, has some special challenges in demonstrating the requirements of patentability at the various Intellectual Property Offices globally. Although the law in most countries is now largely settled, it is still a developing field and subtle differences exist in the approach taken by different IPO, meaning that obtaining experienced advice at the outset is often key in avoiding later pitfalls and in maximising the chances of obtaining broad and commercially useful protection for AI inventions.

Developing international filing strategy for innovative fashion tech company

We are representing a leading UK-based fashion technology company which provides software to allow customised manufacture of small production runs. We advised on an international patent filing for a key piece of its technology relating to customisable manufacture. As was widely reported at the time, the company completed a successful £ multi-million funding round to support further research, growth and development. We took over the patent work from another UK competitor.
