Brexit Draft Agreement – Transition Period to Apply for Intellectual Property Rights

A draft agreement on withdrawal of the UK from the European Union has been published this week.  The agreement provides for a transition period from the Brexit date of 29 March 2019 to the end of December 2020.

The terms set out in the draft have not been finally agreed.  However, it is intended that EU trade marks, design rights, plant variety rights and database rights will continue to have effect in the UK in their current form until at least the end of the transition period on 31 December 2020.

We are watching the situation closely and will provide further updates.
